Terms of Service

1. Acceptance of Terms

By accessing or using the SpecNGo mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service; Professional Tool Disclaimer

SpecNGo is a mobile-first home inspection reporting tool designed to assist professional home inspectors in gathering data, photos, and voice notes to generate inspection reports.

Specifically, you acknowledge and agree that:

• You are the sole author of your inspection reports. While SpecNGo's tools assist in transcribing and formatting observations, you constitute the final authority on the content of your reports and bear full professional responsibility for their accuracy.
• AI-generated narratives are suggestions only. Any text generated by SpecNGo's automated transcription or narrative features is a draft suggestion that must be reviewed, edited, and approved by you before inclusion in any report delivered to a client. You are responsible for verifying the accuracy of all AI-generated content.
• SpecNGo does not provide professional inspection advice. The Service does not perform inspections, does not provide professional opinions, does not certify work, and is not a substitute for your professional judgment, certification requirements, or adherence to applicable Standards of Practice (SOP) in your jurisdiction.
• You are responsible for regulatory compliance. You are solely responsible for ensuring your inspection reports comply with all applicable laws, regulations, licensing requirements, and industry standards (including ASHI, InterNACHI, or state-specific standards).

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Content and Data Ownership

Your Content: You retain all rights and ownership of the inspection data, photos, voice recordings, and reports you generate ("User Content").

License to SpecNGo: By using the Service, you grant SpecNGo a worldwide, non-exclusive, royalty-free license to use, store, copy, and process your User Content solely for the purpose of providing, maintaining, and improving the Service. This includes the use of anonymized data to improve our service quality.

5. Subscriptions and Billing

Paid Subscriptions: Certain features require a paid subscription ("Pro Unlimited") or pay-per-report ("Pay-as-you-go"). By selecting a paid plan, you agree to pay the stated fees. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.

Refunds: Payments are generally non-refundable except as required by law.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You will have a limited window to export your existing reports, subject to our data retention policies.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SpecNGo, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

To the maximum extent permitted by applicable law, SpecNGo's aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total amount of fees actually paid by you to SpecNGo during the twelve (12) month period immediately preceding the event giving rise to the claim. If you have not paid any fees to SpecNGo, SpecNGo's maximum aggregate liability shall not exceed fifty U.S. dollars ($50.00).

Without limiting the foregoing, SpecNGo shall have no liability whatsoever for:

• The accuracy, completeness, or correctness of any inspection report content, including any AI-generated narratives or transcriptions.
• Any disputes between you and your clients arising from or related to inspection reports generated using the Service.
• Any regulatory, licensing, or disciplinary actions taken against you by any governmental or professional body.
• Any third-party claims, demands, or lawsuits arising from your use of the Service or the content of your inspection reports.

8. Indemnification

You agree to defend, indemnify, and hold harmless SpecNGo and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• The content of any inspection reports you generate, publish, or distribute using the Service.
• Your professional practice, including any errors, omissions, or misrepresentations in your inspection work.
• Your violation of any applicable law, regulation, or licensing requirement.
• Any third-party claims based on or arising from the content of your inspection reports or your use of the Service.
• Your breach of these Terms.

This indemnification obligation will survive the termination of these Terms and your use of the Service.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

SpecNGo does not warrant that: (a) the Service will function uninterrupted, be secure, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; (d) any AI-generated content, including transcriptions and narratives, will be accurate, complete, or suitable for any particular purpose; or (e) the results of using the Service will meet your requirements.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
